TrueTale Founding Member Terms and Conditions

1. ACCEPTANCE OF TERMS

By purchasing a TrueTale Founding Member spot ("Founding Membership"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not purchase a Founding Membership.

2. FOUNDING MEMBER PROGRAM DESCRIPTION

2.1 Program Benefits

The Founding Member program provides early supporters with:

• 50% discount off the full retail price of TrueTale subscription (when and if launched)
• Direct communication line with the founder
• Voting rights on select future product features
• Founding Member badge (format to be determined)

2.2 Program Fee

The one-time Founding Member fee is $25.00 USD.

2.3 Limited Availability

Founding Memberships are limited to 100 spots total and are offered on a first-come, first-served basis.

2.4 Non-Transferable

Founding Memberships are personal to the purchaser and may not be transferred, sold, or gifted to another person.

3. PRODUCT DEVELOPMENT DISCLAIMER

IMPORTANT:

You acknowledge and agree that:

• TrueTale is currently in development and has not been released
• There is no guarantee that TrueTale will be completed or launched
• The anticipated launch date of November 20th, 2025 is an estimate only and may change without notice
• There is no maximum time limit on development
• You are purchasing a Founding Membership spot with full knowledge of these uncertainties

4. REFUND POLICY

4.1 Pre-Launch Refunds

You may request a full refund of your $25.00 Founding Member fee at any time before the official launch of TrueTale by contacting support@truetale.app.

4.2 Post-Launch Refunds

Once TrueTale officially launches, the $25.00 Founding Member fee becomes non-refundable. The TrueTale subscription itself will be subject to its own terms and refund policy, which will be clearly communicated at the time of launch.

4.3 Refund Consequences

Upon receiving a refund, you will immediately lose all Founding Member benefits, including the 50% lifetime discount. Your Founding Member spot may then be offered to others.

5. DISCOUNT TERMS

5.1 Lifetime Discount

The 50% discount applies to all future TrueTale subscription fees for as long as you maintain an active, uninterrupted subscription.

5.2 Discount Forfeiture

You will permanently lose the 50% discount if you:

• Request and receive a refund of your Founding Member fee
• Cancel your TrueTale subscription after launch and later re-subscribe
• Violate these Terms or TrueTale's future Terms of Service

5.3 No Price Guarantee

While you will receive 50% off the retail price, the actual subscription prices have not been set and may vary upon launch.

6. COMMUNICATIONS

6.1 Consent to Communications

By purchasing a Founding Membership, you consent to receive email communications regarding:

• Product development updates
• Beta access information
• Launch announcements
• Feature voting opportunities

6.2 Unsubscribe Rights

You may unsubscribe from non-essential communications at any time via the unsubscribe link in our emails. Note that unsubscribing does not affect your Founding Member status or benefits.

7. DATA PROTECTION

7.1 Personal Data Collection

We collect and process:

• Your full name
• Email address
• Payment information (processed securely via Stripe)

7.2 GDPR Compliance

As a data controller, Andrea Giulio Cerasoni (trading as TrueTale), Lytchett House, 13 Freeland Park, Wareham Road, Poole, Dorset, BH16 6FA, will process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

7.3 Data Usage

Your personal data will be used solely for:

• Processing your Founding Member purchase
• Providing Founding Member benefits
• Sending program-related communications
• Compliance with legal obligations

7.4 Analytics and Cookies

We use anonymous analytics cookies to understand how visitors use our website and improve our services. You can accept or decline these cookies via our cookie consent banner. No personal data is collected through our analytics.

8. INTELLECTUAL PROPERTY

All intellectual property rights in TrueTale remain the exclusive property of Andrea Giulio Cerasoni. The Founding Membership grants no ownership rights in TrueTale or its underlying technology.

9. LIMITATION OF LIABILITY

9.1 Disclaimer

ANDREA GIULIO CERASONI, TRADING AS TRUETALE, PROVIDES THE FOUNDING MEMBER PROGRAM "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

9.2 Liability Cap

To the maximum extent permitted by law, Andrea Giulio Cerasoni's total liability for any claims arising from or related to the Founding Member program shall not exceed the amount paid for your Founding Membership ($25.00).

9.3 Exclusions

Andrea Giulio Cerasoni shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10. MODIFICATIONS

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to the address associated with your Founding Membership at least 30 days before taking effect.

11. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.

12. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

13. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Andrea Giulio Cerasoni regarding the Founding Member program and supersede all prior agreements and understandings.
